Terms and Conditions for Hotel Accommodation Contracts

These general hotel service provision terms (hereafter called the Terms) define the order and terms of services provided by the UAB “Bolligers” hotel Palaima (hereafter called the Hotel) located at Anyksciai district Mačionių village Ežero str. 8D.

I. CONCLUSION OF CONTRACT
A Hotel accommodation contract (hereafter called “Contract”) is established when a guest booking inquiry is responded to with a booking confirmation from the Hotel.
Parties to the Contract are the Hotel and the client who uses the service of the Hotel. If a third party has made a reservation on behalf of the client, such third party and the client shall be jointly and severally liable to the Hotel for all obligations arising out of the hotel accommodation contract.
The number of persons, price, accommodation and other products and services to be provided by the Hotel will be stated on the confirmation received by the guest after ordering Children under 12 years only allowed in July and August.
Reservations may only be made electronically via the online and mobile channels of Hotel or through third parties/intermediaries (e.g. online booking portals). Reservations by phone, email or other non-automated reservation methods are subject to the prior consent of Hotel.

II. PRICES, TAXES AND DUTIES
The applicable prices correspond to the total price and are inclusive of all statutory taxes, fees and duties. In the event of any changes to the tax rates, fees and duties and the effective collection of new taxes, fees or duties of which the parties were not previously aware, Hotel reserves the right to adjust the prices accordingly. The accommodation prices shown refer to the room price per night.

III. PAYMENT
Hotel accept the most common credit/debit cards. The Hotel is not obliged to accept foreign currency, vouchers, cheques or credit/debit cards unless the hotel has volunteered to do so.
For a reservation to be valid, at the time of booking the guest must either provide details of a valid credit card or indicate an alternative method of payment on the electronic sales channels of Hotel. Hotel has the right to an immediate check of the validity of such information and to carry out a pre-authorisation of the credit card or alternative payment method indicated. With the pre-authorization a temporary hold is put on the funds of the credit card or alternative payment method. The full cost of accommodation plus any additional services booked will then be charged to the credit card or alternative payment method indicated no later than the date of arrival.
Hotel is entitled to charge to the credit card or alternative payment method indicated also any outstanding amount(s) owed by the guest to Hotel for open positions particularly related to later additional bookings and/or use of facilities and services (e.g. of the minibar) or guest behavior.
For non-refundable rate bookings, marked as such in the description or conditions, the full amount of the stay will be charged at the time of booking.

IV. CHECK-IN AND CHECK-OUT
Ordered Hotel rooms are guaranteed to be ready for checking in from 15:00 p.m. on the date of arrival. The check-out time is determined by the Hotel from 11:00 a.m. on the departure date.
Guests fail to return their room on the date of departure by 11.00 a.m. in a tidy condition, this will lead to an obligation to pay Hotel damages in a lump sum fee equal to the full price of one night for the hotel room.

V. CANCELATION
Cancellation terms depend on the price agreed at the time of booking.
Cancelation, made earlier then 72 hours before expected arrival time (expected arrival time is understood 15:00 hours (2 PM) local time (Lithuania) on the day of arrival) refund 100 %.
Cancellation, made from 72 hours until 24 hours before expected arrival time (expected arrival time is understood 15:00 hours (2 PM) local time (Lithuania) on the day of arrival) refund 50%).
If the guest fails to cancel the reservation before the free cancellation deadline or in the case of no-show (guest would not cancel the reservation and would not arrive until midnight to Hotel premises and would not inform the hotel about late arrival), the Hotel is entitled to charge the first night's accommodation cost as cancellation penalty.
Reservations with NON-REFUNDABLE conditions will not be subject to any changes and/or cancellations. The deposit (money paid in advance) will not be reimbursed. In the case of cancellation, modification or in the case of no-show, the total amount is taken as a cancellation penalty and no part of the payment will be refunded under any circumstances.
By confirming booking with non-refundable conditions, the client acknowledges that there is no legal right to be reimbursed, neither in the case of change of plans nor in the case of force majeure.

VI. OPTIONS OF USE OF PUBLIC AREAS
With the reservation and booking of a room, the guest can use the designated public areas, such as the bar, lake, etc. without any extra costs. Hotel reserves the right to close the public areas on a short notice without warning. In case of non-availability of a public area, ​​the guest is not entitled to full or partial reimbursement of payment for accommodation services. The public areas are not considered to be part of the Accomodation Agreement for the booked Hotel room.

VII. PETS
It is prohibited to bring pets into the Hotel. Hotel has the right to make exceptions to some kinds of pets. Exceptions to this are dogs for the blind, hard of hearing or other comparable service dogs, which may be brought at no charge and at any time.

VIII. SMOKING
Hotel is non-smoking hotel. It is thus prohibited to smoke either in the common areas or the guest rooms. In the event of an infringement, Hotel has the right to demand an amount of EUR 150.00 from the guest by way of damages for the additional cleaning charges, as well as any loss in turnover due to the room being unavailable. The amount of damages charged may be higher or lower, if Hotel proves a higher amount of damage or the guest proves a lower amount of damage.

IX. RESPONSIBILITY ON YOUR VALUABLES
The Hotel is not responsible for valuables stored in your room.
The Hotel is not responsible for damage or disappearance of vehicles kept in the Hotel’s parking area or valuables inside the vehicle.
X. GUEST’S RESPONSIBILITY ON DAMAGE
As a guest you are responsible for damage caused on purpose or by accident by you, your guest or your pet (if allowed) in the Hotel room or in Hotel premises. This applies also to the Hotel furniture and other equipment, other guests in the Hotel or their property.
The responsibility for caused damage is determined by general principles.

XI. DOMICILIARY RIGHT
Hotel reserves the right to send guests away from the Hotel. This applies in particular, if guests do not observe instructions given by Hotel employees, express themselves in a discriminating manner, harass or endanger other guests.

XII. FINAL PROVISIONS
Any modifications or amendments must be made in writing. Any statements and notifications necessary, pursuant to the contract for accommodation and these terms and conditions of business must be made in writing, unless expressly agreed otherwise. Hotel is entitled to assign any rights or claims arising from the contract for accommodation to third parties. Hotel is entitled to have obligations arising from and in connection with the contract for accommodation fulfilled by third parties.
If one or more of the above provisions is invalid, this will not affect the validity of the remaining provisions. The invalid provisions are to be replaced by a valid provision which comes as near as possible to the economic and legal intentions of the parties. Any modifications and amendments to the contract or to the general terms and conditions of business must be made in writing. Unilateral modifications or amendments by the Guest are invalid.
All disputes that may arise between the parties to this agreement (the guest and the Hotel), shall be resolved in accordance with Lithuanian law.
